Booking Terms & Conditions
These General Terms and Conditions are governed by the provisions of Royal Decree 1/2007 of 16 November, on the General Law for the Protection of Consumers and Users and other supplementary laws, as amended by Royal Decree-Law 23/2018 of 21 December, transposing directives on trade marks, rail transport and and linked travel arrangements, Act 4/2022 of 25 February on the protection of consumers and users in situations of social and economic vulnerability, and by Act 7/1998 of 13 April on general terms and conditions of contract, and by the provisions set out below.
1) GENERAL INFORMATION

Any contract entered into with Wave Atlas is subject to these general terms and conditions of sale, which are set out in full below, so that each CUSTOMER may familiarise themselves with and verify the purchase and the specific terms.
The purpose of these general terms and conditions is to regulate the contractual terms for the provision of services by Wave Atlas and, where applicable, the consideration payable by the customer to Wave Atlas for the customer’s use of certain services. The provision of services shall be carried out through the acquisition, provision, organisation, use and management by Wave Atlas of the technical, human and operational resources necessary for this purpose and, in all cases, in return for payment at the prices in force at any given time where the services are subject to a charge. Simply browsing the website www.thewaveatlas.com shall not be considered a service.
Wave Atlas takes special care to safeguard travellers in accordance with the terms set out in these general terms and conditions, as well as in the legal notice and privacy policy, by means of:
DEFINITIONS
A. Package holiday: this is a holiday in which at least two travel services are combined for the purposes of the same trip or holiday, provided that the combination is set out in a single contract, regardless of whether or not the traveller requests it. A package holiday is also considered to be one which, despite being set out in several contracts:
It is carried out at one of our points of sale
The combination of travel services is selected before the traveller agrees to pay
It is offered, sold or invoiced by the organiser, or where applicable the retailer, at a fixed or all-inclusive price.
It is advertised by the organiser, or where applicable the retailer, as a ‘package holiday’
Such contracts entitle the traveller to choose from a selection of different travel services
Finally, contracts concluded via www.thewaveatlas.com (through a linked online booking process) are also considered package travel contracts, whereby the traveller enters into a single contract with the organiser, but several contracts with the providers of the services contracted by the traveller no later than 24 hours following confirmation of the final booking.
A package holiday is also considered to be one that combines a travel service (transport, accommodation and car hire) with one or more tourist services, provided that :
The tourist services account for 25 per cent or more of the value of the package and are advertised as an essential feature of the package; or
If the tourist services were only contracted after the performance of one travel service (transport, accommodation or car hire) had commenced
B. Travel services: Travel services include the carriage of passengers, accommodation where this is not an integral part of the carriage of passengers and is not for residential purposes, the hire of passenger cars (Royal Decree 750/2010 of 4 June) and any other tourist service that does not form an integral part of one of the travel services mentioned above.
C. Package Holiday Contract: a contract formalised in a single agreement covering the entire trip, or the formalisation of several contracts for each of the travel services included in the package holiday on offer.
D. Start date of the package holiday: the day on which the provision of the travel services included in the contract begins.
E. Repatriation: the traveller’s return to the place of departure or to any other place agreed by the contracting parties.
F. Lack of conformity: the failure to perform or the incorrect performance of the travel services included in a package holiday.
G. Traveller: any person who intends to enter into a contract or is entitled to travel under a contract.
H. Business operator: a person who deals with travellers in person or online, whether acting as an organiser, retailer, business operator providing travel services, or as a provider of travel services.
I. Organiser: a trader who combines and sells or offers package holidays directly, through or in conjunction with another trader.
J. Retailer: a trader other than the organiser who sells or offers package holidays arranged by an organiser.
K. Non-conformity: the failure to perform, or the incorrect performance of, the travel services included
in a package travel contract.
L. Minor: any person under the age of eighteen.
M. Unavoidable and extraordinary circumstances: these shall be deemed to be situations which are beyond the control of the party invoking the situation and the consequences of which could not have been avoided even if all reasonable measures had been taken.
N. Point of sale: refers to any retail outlet, whether movable or immovable, or to a retail website or a similar online retail platform, even where such websites or platforms are presented to travellers as a single platform, including a telephone service.
O. Establishment: the taking up and pursuit of a self-employed economic activity, as well as the formation and management of businesses and, in particular, companies, under the conditions laid down by law, for an indefinite period, in particular by means of a permanent infrastructure.
P. Pre-contractual information: Pre-contractual information means the information which the organiser or, where applicable, the retailer is obliged to provide to the traveller before the traveller becomes bound by any contract or offer.
IMPORTANT INFORMATION ON COMBINED TRIPS
The information contained in these General Terms and Conditions for Package Tours and that provided at the pre-contractual stage is of a general nature. No significant changes to the content are to be expected, and they will be amended solely in accordance with the terms set out in the Special Terms and Conditions and in certain circumstances set out below.
Organisation of the package holiday
Package tours are organised by the wholesale agency specified in the pre-contractual information provided to the customer and set out in the package tour contract.
The package holiday contract
The agency undertakes to provide the traveller with a copy of the package holiday contract entered into by the parties, no later than 24 hours from the time of its conclusion. All the terms and conditions governing the package holiday booked shall form an integral part of the package holiday contract, specifically the general terms and conditions set out in this document, the pre-contractual terms and conditions, and the specific terms and conditions agreed between the agency and the traveller.
Price
A) The price of the package holiday includes:
The price of all tourist services expressly contracted and included in the pre-contractual information and in the package holiday contract, regardless of whether this has been set out in one contract or in several contracts
Commissions, surcharges and additional costs
The provision of assistance by the organiser, or where applicable the retailer, if the traveller finds themselves in difficulty, particularly in cases of extraordinary and unavoidable circumstances and those provided for in the applicable regulations
The possibility of requesting assistance when experiencing difficulties in lodging a complaint regarding any non-conformity experienced by the traveller during the trip
B) The price of the package holiday does not include:
Any other services not specifically mentioned in the pre-contractual information and in the contract, such as:
Flights or transport to and from the destination, unless expressly stated otherwise in the specific terms and conditions of the trip
Visas, administrative authorisations, vaccination certificates, medical tests or any other documentary or health-related formalities required by the authorities of the country of destination, transit or departure
Travel insurance, unless expressly stated otherwise. Where travel insurance is compulsory to take part in the trip, the traveller must take out a policy
Meals, drinks, equipment hire, lessons, activities, excursions, transport, personal expenses and any other services not expressly stated as included
Any additional taxes at certain destinations, which may vary depending on the category of the accommodation and the destination. These charges are to be paid directly at the hotel, and the traveller shall be solely responsible for paying them
Airport arrival/departure taxes/fees where applicable
C) Price changes:
The price of the package holiday has been calculated on the basis of exchange rates, transport fares and the cost of fuel. Due to the constant rise in the price of oil or other energy sources, on occasion, the price of the package holiday may be amended after the booking has been made and the trip confirmed, by the organiser, or where applicable by the retailer, provided that such a right is stipulated in the contract entered into.
Depending on the destination, travellers will be charged, as an integral part of the total price of the package holiday, tourist taxes, duties and surcharges for landing, embarkation or disembarkation at ports or airports, as specified in the previous section. These amounts may be amended by third parties who are not directly involved in the organisation of the package holiday and, as a result, may be amended by the agency.
With regard to the tourist tax, this is a charge levied by hotels in certain countries. Travellers should check whether such a tax applies to their destination.
As a result of changes in the exchange rate applicable to the package holiday, the agency may adjust the price of the holiday.
Any price changes arising as a result of any of the reasons set out above shall be notified by Wave Atlas to the traveller, together with the justification for the increase and its calculation in a durable medium, no later than twenty calendar days before the start date of the package holiday.
Provided that the travel contract grants the organiser, or where applicable the retailer, the right to amend the price, as is the case here, the traveller shall be entitled to a price reduction corresponding to any decrease in the costs mentioned in this section that occurs between the date of confirmation of the package holiday booking and the start date of the package holiday. In the event of a price reduction, the organiser and, where applicable, the retailer, shall be entitled to deduct the actual administrative costs from the refund due to the traveller.
D) Price reduction and compensation for damages:
The traveller shall be entitled to an appropriate price reduction for any period during which there has been a lack of conformity, unless the organiser or retailer proves that the lack of conformity is attributable to the traveller.
The traveller shall be entitled to receive appropriate compensation from the organiser or, where applicable, the retailer for any loss or damage suffered as a result of any lack of conformity. The compensation shall be paid without undue delay.
The traveller shall not be entitled to compensation for loss or damage if the organiser or, where applicable, the retailer proves that the lack of conformity is:
attributable to the traveller
attributable to a third party not involved in the provision of the contracted services and which is unforeseeable or unavoidable
due to unavoidable and extraordinary circumstances
To the extent that international conventions binding on the European Union limit the scope or conditions of compensation payable by travel service providers included in a package holiday, the same limitations shall apply to organisers and retailers. In all other cases, the contract may limit the compensation payable by the organiser or retailer, provided that such a limitation does not apply to personal injury or damage caused intentionally or through negligence, and that the amount is not less than three times the total price of the trip.
Any right to compensation or a price reduction under the provisions of the applicable law shall not affect the rights of travellers as set out in:
Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to air passengers in the event of denied boarding and of cancellation or significant delays to flights, and repealing Regulation (EEC) No 295/91.
Regulation (EC) No 1371/2007 of the European Parliament and of the Council of 23 October 2007 on the rights and obligations of rail passengers.
Regulation (EC) No 392/2009 of the European Parliament and of the Council of 23 April 2009 on the liability of carriers of passengers by sea in the event of an accident.
Regulation (EU) No 1177/2010 of the European Parliament and of the Council of 24 November 2010 concerning the rights of passengers travelling by sea and inland waterways and amending Regulation (EC) No 2006/2004.
Regulation (EU) No 181/2011 of the European Parliament and of the Council of 16 February 2011 on the rights of bus and coach passengers and amending Regulation (EC) No 2006/2004.
International conventions.
E) Agreed method of payment
The parties shall agree in the contract on the method of payment, whether in cash or in instalments, although the full amount must be paid before the departure date. Should the payment not have been received, it shall be deemed that the traveller has unilaterally withdrawn from the contract, subject to the costs and penalties set out in Royal Decree-Law 1/2007.
Attendance
The traveller may send messages, requests or complaints regarding the performance of the package holiday directly to the retailer through whom it was purchased. The retailer shall forward such messages, requests or complaints to the organiser without undue delay. For the purposes of complying with the terms or limitation periods, the acknowledgement of receipt by the retailer of the messages, requests or complaints shall be deemed to be an acknowledgement of receipt by the organiser
The organiser and the retailer must provide adequate assistance without undue delay to travellers in difficulty, particularly in the event of unavoidable and extraordinary circumstances, in particular by:
providing adequate information on healthcare services, local authorities and consular assistance
assisting the traveller in establishing remote communications; and
helping to find alternative travel arrangements
The organiser and, where applicable, the retailer may charge a reasonable surcharge for such assistance if the difficulty was caused intentionally or through the traveller’s negligence. Such a surcharge shall in no case exceed the actual costs incurred by the organiser or the retailer
If it is impossible to ensure the traveller’s return as agreed in the contract due to unavoidable and extraordinary circumstances, the organiser or, where applicable, the retailer shall bear the cost of any necessary accommodation, where possible of a standard equivalent accommodation, for a period not exceeding three nights, with the cost of any excess charges to be borne by the traveller
Amendments to other clauses of the contract
The package holiday contract, subject to the provisions of the previous point, may be amended unilaterally by the organiser or, where applicable, the retailer, prior to the commencement of the package holiday, provided that the change is minor, that such power is provided for in the contract entered into with the traveller, and that the traveller is informed in a durable medium of any resulting change in price
However, in cases where the organiser is obliged to amend any of the main features of the package tour set out in the pre-contractual or contractual terms and conditions, or proposes to the traveller an increase in the price of the package tour of more than eight per cent (8%) of the total price – provided this is always before the start of the package tour – the traveller shall have the option of accepting the proposed change or terminating the contract without penalty
Should the replacement package tour be of a lower standard or cost than the modified one, the traveller shall be entitled to a reduction in price
Any amendments to the terms of the contract must be communicated to the traveller without delay, specifying: the impact of the amendment on the total price of the package holiday; the deadline by which the traveller must communicate their decision to terminate or accept the amendments and what happens if the traveller fails to respond; and, where applicable, the substitute holiday offered and its price
Should the traveller request voluntary changes to their package holiday, the prices of the tourist services may differ from those published in the brochure or the pre-contractual terms and conditions on which the contract was based.
Assignment of the package holiday contract
For the traveller to be entitled to transfer the package holiday contract to another person, the transferee must meet all the conditions applicable to that contract, and the organiser or, where applicable, the retailer, must be notified in advance, with a reasonable notice period of at least seven (7) calendar days prior to the start of the package holiday
Both the transferor and the transferee shall be jointly and severally liable for the payment of the outstanding amount, as well as for any additional costs incurred as a result of the transfer. To this end, it is the organiser or the retailer who must provide the transferor with proof of the additional costs
Payments and refunds
The package holiday must be paid for in full within the timeframes set out in the pre-contractual information, specific terms and conditions or the travel offer. In the event of non-payment of the deposit or any of the outstanding payments within the agreed timeframe, Wave Atlas may consider that the traveller is unilaterally withdrawing from the contract, in which case the relevant penalties or cancellation charges will apply
Should full payment of the price agreed in the terms and conditions not be received, it will be assumed that the traveller is withdrawing from the trip, in which case the provisions of section “2.8. Termination of the package holiday contract by the traveller” shall apply
Should Wave Atlas terminate the package holiday contract, it must return or reimburse the traveller for the amounts already paid by the traveller, within a period not exceeding fourteen calendar days from the date of completion of the package holiday
A traveller who fails to present themselves at the scheduled departure time of the contracted package holiday shall not be entitled to a refund of any amount paid, unless otherwise agreed between the parties
With regard to the cancellation insurance taken out by the traveller, under no circumstances shall the premium paid by the traveller be refundable
Payment by bank transfer or other accepted methods: for the payment of booked services, Wave Atlas may provide the traveller with bank details or other accepted payment methods. The traveller must correctly state the booking reference and retain proof of the payment made
Termination of the package holiday contract by the traveller
At any time, but always before the start date of the package holiday, the traveller may terminate the contract. In such a case, Wave Atlas may charge a reasonable and justifiable penalty, in accordance with the provisions of the applicable regulations and the specific terms and conditions provided prior to booking
Unless the specific terms and conditions of the booked holiday set out a different penalty or cancellation schedule, the initial deposit paid by the traveller, equivalent to approximately 30 per cent of the total cost of the package holiday, shall be refundable provided that the cancellation is notified at least one month in advance of the scheduled start date of the holiday
Should the cancellation be notified within the month prior to the start date of the trip, the initial deposit shall no longer be refundable and may be retained by Wave Atlas as a penalty for the traveller’s termination of the contract, without prejudice to the possibility of more specific terms and conditions applying to each trip
In the event that the contracted and cancelled services, which form part of the package holiday, are subject to special financial terms and conditions, the cancellation fees for withdrawal shall be those established by the provider of each service
Where, as a result of changes to the terms of the package holiday contract, the traveller does not accept a replacement trip, the organiser shall refund the traveller the sums paid, without applying any penalties, within a maximum period of fourteen calendar days from the date of termination of the contract
The following shall be entitled to terminate the contract and receive a full refund of the price of the package holiday:
travellers whose booked package is affected by unavoidable and extraordinary circumstances at the destination, or in the immediate vicinity, which significantly affect the performance of the package or the transport of passengers to the destination
if any of the essential elements of the package, other than the price, are significantly altered
in the event that the organiser responsible for the package tour cancels it before the start of the trip, the traveller shall also be entitled to receive compensation
in the event of non-performance of the services where this substantially affects the performance of the package tour and the organiser or, where applicable, the retailer fails to resolve the problem
Where exceptional circumstances arise, such as serious security issues that may affect the trip, travellers shall not be required to pay any penalty
Travellers shall be entitled to a price reduction and/or compensation for damages in the event of non-performance or improper performance of travel services
Right of withdrawal: package holidays are not subject to the right of withdrawal; however, those travellers who book a package holiday off-premises (not to be confused with contracts concluded at a distance) will have a period of fourteen days in which to exercise their right of withdrawal with Wave Atlas.
The following are contracts concluded off-premises:
Contracts concluded in the simultaneous physical presence of the trader and the traveller and user, at a location other than the trader’s business premises
Contracts in which the traveller and user has made an offer under the same circumstances as those set out in point (a)
Contracts concluded at the trader’s business premises or through the use of any means of distance communication immediately after there has been personal and individual contact with the traveller and user at a place other than the trader’s business premises, with the simultaneous physical presence of the trader and the traveller and user
Contracts concluded during an excursion organised by the trader for the purpose of promoting and selling products or services to the traveller and user
Termination of the contract by the organiser or retailer
Wave Atlas may cancel the package holiday contract and refund the traveller the full amount of the payments made, without being liable for any additional compensation, where any of the circumstances provided for by law apply, in particular where the minimum number of participants specified in the contract is not reached or where Wave Atlas is unable to carry out the trip due to unavoidable and extraordinary circumstances.
Liability for booking errors
The trader shall be liable for errors arising from technical faults in the booking system for which they are responsible, as well as for errors made during the booking process, where the trader has agreed to handle the booking of a package holiday
The trader shall not be liable for booking errors attributable to the traveller or caused by unavoidable and extraordinary circumstances
Performance of the package holiday contract
Organisers and retailers of package holidays shall be liable to the traveller for the proper performance of the travel services included in the contract, in accordance with the obligations incumbent upon them in relation to their respective areas of responsibility for the management of the package holiday, regardless of whether these services are to be provided by themselves or by other service providers. Notwithstanding the foregoing, the traveller may address complaints regarding non-performance or defective performance of the services comprising the package tour to either organisers or retailers, who shall be obliged to provide information on the applicable liability regime, to process the complaint directly or by referring it to the appropriate party depending on the scope of management, and to keep the traveller informed of the progress of the complaint even if it falls outside their scope of management
The party liable to the traveller shall have a right of recourse against the operator to whom the non-performance or defective performance of the contract is attributable, in accordance with their respective scope of responsibility for the package tour.
Where an organiser or retailer pays compensation, in accordance with their scope of responsibility, grants a price reduction or fulfils the other obligations imposed by this act, they may seek reimbursement from third parties who contributed to the occurrence of the event giving rise to the compensation, the price reduction or the fulfilment of other obligations
The traveller must inform the organiser or, where applicable, the retailer without undue delay of any lack of conformity that they observe during the provision of a travel service included in the contract
If any of the services included in the package are not performed in accordance with the contract, the organiser and, where applicable, the retailer must remedy the lack of conformity, unless this proves impossible or would entail disproportionate cost, taking into account the seriousness of the lack of conformity and the value of the travel services affected. Should the non-conformity not be remedied in accordance with this paragraph, a reduction in the price and compensation for damages shall apply
Without prejudice to the exceptions provided for in the previous paragraph, if the organiser or the retailer fails to remedy the non-conformity within a reasonable period set by the traveller, the traveller may do so themselves and claim reimbursement of the necessary expenses. It shall not be necessary for the traveller to specify a deadline if the organiser or, where applicable, the retailer refuses to remedy the lack of conformity or if an immediate solution is required
Where a significant proportion of the travel services cannot be provided as agreed in the package travel contract, the organiser or, where applicable, the retailer, shall offer, at no additional cost to the traveller, suitable alternative arrangements, where possible, of a quality equivalent to or higher than that specified in the contract, for the continuation of the package holiday, including where the traveller’s return to the place of departure does not take place as agreed.
If the proposed alternative arrangements result in a package holiday of a lower standard than that specified in the contract, the organiser or, where applicable, the retailer shall grant the traveller an appropriate price reduction.
The traveller may only reject the proposed alternative arrangements if they are not comparable to what was agreed in the package travel contract or if the price reduction granted is inadequate
Where a lack of conformity substantially affects the performance of the holiday and the organiser has not remedied it within a reasonable period set by the traveller, the traveller may terminate the contract without paying any penalty and may, where appropriate, claim both a reduction in the price and compensation for any loss or damage suffered.
If the package tour includes passenger transport, the organiser and, where applicable, the retailer, in the cases set out in the two preceding paragraphs, shall also repatriate the traveller on equivalent transport without undue delay and at no additional cost
If it is impossible to ensure the traveller’s return as agreed in the contract due to unavoidable and extraordinary circumstances, the organiser or, where applicable, the retailer shall bear the cost of any necessary accommodation, if possible of an equivalent standard, for a period not exceeding three nights per traveller. Where European regulations on passenger rights, applicable to the relevant means of transport for the traveller’s return, provide for longer periods, those periods shall apply
The cost limit referred to in the previous paragraph shall not apply to persons with disabilities or reduced mobility, as defined in Article 2(a) of Regulation (EC) No 1107/2006 of the European Parliament and of the Council of 5 July 2006 concerning the rights of persons with disabilities or reduced mobility when travelling by air, nor to their companions, pregnant women and unaccompanied minors, nor to persons requiring specific medical assistance, provided that their particular needs have been communicated to the organiser or, where applicable, the retailer at least forty-eight hours before the start of the journey. The organiser and the retailer may not invoke unavoidable and extraordinary circumstances for the purposes of limiting liability if the carrier cannot invoke these circumstances under European legislation
Insolvency of the organiser or retailer
Should Wave Atlas become insolvent, payments made by the traveller will be refunded.
Should Wave Atlas become insolvent after the start of the package holiday and should the package include transport, the repatriation of travellers will be guaranteed.
Insolvency guarantee: Wave Atlas Travel S.L. has taken out an insolvency protection guarantee with AXA Seguros Generales S.A. (Policy No.: 7751-86646822) in the event that the agency becomes insolvent.
If services are denied due to the insolvency of Wave Atlas, travellers may contact that organisation or, where applicable, the competent authority.
Limitation period for legal actions
Claims arising from the rights recognised in the act shall be time-barred after two (2) years, with the limitation period commencing on the date the contract is concluded.
Applicable jurisdiction
The parties entering into a contract under these general terms and conditions agree to submit to the courts and tribunals of the traveller’s place of residence or the organiser’s place of residence, at the traveller’s discretion, for the resolution of any disputes or claims arising from the interpretation or performance of the package holiday contract and these general terms and conditions.
ACCOMMODATION
At most accommodation providers, the room will be available to the traveller from the check-in time specified by the establishment on the day of arrival until the check-out time specified on the day of departure. The specific times will be those set by each accommodation provider or as stated in the travel documentation.
The user undertakes to use the services in accordance with the law of the country where they are staying, morals, good customs and public order. Consequently, they are obliged not to use the services for any unlawful purposes or effects and/or in contravention of the provisions set out herein, or in any way that may damage the services, the establishment and/or its image.
Where the traveller expects to arrive at the accommodation outside the times specified in the travel documents or by the establishment itself, they must notify Wave Atlas or the accommodation as far in advance as possible; Wave Atlas shall not be liable for any consequences arising from a failure to notify on the part of the traveller.
The specific features and arrangements of the accommodation will be set out in the pre-contractual information and/or the package holiday contract. Wave Atlas holidays may include accommodation in a shared room, double room, single room, villa, hotel, guesthouse or other type, as specified for each specific holiday.
Facilities and services such as restaurants, sports or leisure activities, health or beauty treatments, equipment hire, optional excursions or additional services offered by the accommodation or local suppliers may be subject to availability and direct payment by the traveller, unless expressly stated as included.
The quality and content of the services provided by the hotel will be determined by the official tourist category, if any, assigned by the competent authority of the country to which you are travelling. In the absence of such a category, hotels are classified by star rating based on criteria common to the hotel sector, taking into account their services and facilities, and this classification is provided for guidance only.
SURFING, WATER SPORTS AND LOCAL EXPERIENCES
Wave Atlas holidays include surfing, water sports, yoga, excursions, cultural workshops and other experiences at the destination. These activities will be provided in accordance with the terms set out in the pre-contractual information and/or the package holiday contract, and may be carried out directly by Wave Atlas or by third-party providers.
Surfing and other water sports will be subject to weather conditions, sea conditions, tides, wave conditions, the group’s ability level, supplier availability and safety criteria. Wave Atlas may adjust the timetables, order, location, spot or programme of the activities where this is necessary for operational, weather-related, safety or availability reasons, whilst always endeavouring to maintain the nature and quality of the booked trip.
The traveller must follow the instructions of Wave Atlas, the monitors, guides, instructors and local suppliers at all times. Wave Atlas may prevent or restrict the traveller’s participation in a specific activity where, for objective reasons relating to safety, physical or technical ability, health, behaviour or environmental conditions, their participation may pose a risk to the traveller themselves, to the group or to third parties.
Surfing or sports equipment will only be included where this is expressly stated and, in particular, during the guided sessions included in the trip. The hire of equipment for use during free time, surfing outside the included sessions, or the booking of additional lessons or activities will not be included unless expressly stated.
Where the traveller chooses to bring their own sports equipment, surfboard, photographic equipment, action camera or other personal items, they shall be responsible for their transport, safekeeping and use, as well as for taking out any insurance or cover they deem appropriate.
REDUCED MOBILITY, SPECIAL NEEDS AND INSURANCE
Due to the nature of certain Wave Atlas trips, which may involve physical activities, surfing, water sports, local transfers, boat trips, travel through natural environments and accommodation that may not be adapted, these trips may not be suitable for people with reduced mobility, disabilities, injuries, medical conditions, pregnancy, specific medical needs or other personal circumstances that may affect the safe completion of the trip.
The traveller must inform Wave Atlas, before booking and, in any event, before the start of the trip, of any medical condition, injury, allergy, food intolerance, dietary requirement, reduced mobility, disability or special need that may affect the provision of services or their participation in activities. Wave Atlas will, at the traveller’s request, provide information on the suitability of the trip based on the needs disclosed, without this constituting a guarantee of accommodation if the nature of the trip or the service providers does not permit it.
Unless expressly stated otherwise, the traveller must have adequate travel insurance. Where insurance is compulsory for the specific trip, it must cover, as a minimum, medical assistance, cancellation, repatriation and the surfing, water sports or other sporting activities included in the itinerary. Failure to take out or provide proof of compulsory insurance may prevent participation of the traveller during the trip or whilst engaging in certain activities, without prejudice to the consequences set out in the special conditions.
ADMINISTRATIVE DOCUMENTATION, VISAS AND VACCINATIONS
The traveller is responsible for ensuring they have the necessary personal, administrative and health documentation for entry, stay, transit and departure from the country or countries of destination and transit, including a passport, visas, authorisations, health certificates, vaccinations, medical tests or any other formalities that may be required.
Wave Atlas may provide general information on documentation or health requirements, but such information is provided for guidance only and may vary at the discretion of the relevant authorities. The traveller must always verify the most up-to-date information with the Ministry of Foreign Affairs, European Union and Cooperation, the relevant embassy or consulate, and the relevant health or immigration authorities.
In the event that the traveller is unable to commence or continue their journey, is turned away by an authority, is refused boarding on a flight, entry, stay, transit or departure, or incurs additional costs due to a lack of the required documentation or failure to meet the necessary requirements, Wave Atlas shall not be liable for such expenses, nor will the cost of the trip be refunded, unless legally required to do so for reasons attributable to Wave Atlas.
